BettaYou Terms & Conditions
Last updated: 15 October 2026
1. About these terms
1.1 These terms apply when you use bettayou.com.au or buy from us. "We", "us" and "BettaYou" means BettaYou Pty Ltd (ABN 74 666 551 177), based in Sydney, NSW. "You" means the person using the website or placing an order.
1.2 By placing an order you agree to these terms, together with our Refund Policy and Privacy Policy.
1.3 Nothing in these terms excludes, restricts or changes any right you have under the Australian Consumer Law or any other law that cannot be excluded. If anything in these terms appears to do so, that part does not apply.
2. Using our website
2.1 You must be 18 or older to place an order, or have the permission of a parent or guardian.
2.2 If you create an account, please keep your login details secure and let us know straight away if you think someone else has used your account.
2.3 You must not use our website for anything unlawful, to interfere with its security or operation, to send spam, or to copy or scrape its content. If you do, we may suspend or close your account after letting you know why.
3. Our products and the information we provide
3.1 We take care to describe our products accurately, including their ingredients, nutrition information and serving sizes. Product photos are illustrations, and colours may look slightly different on your screen.
3.2 Information on our website, in our emails and on social media is general nutrition and wellbeing information only. It is not medical advice and is not a substitute for advice from your doctor, dietitian or other health practitioner.
3.3 Our products are foods, not medicines. They are not intended to diagnose, treat, cure or prevent any disease or condition.
4. Orders, prices and payment
4.1 All prices are in Australian dollars and include GST. Delivery charges are shown at checkout before you pay.
4.2 Your order is an offer to buy. A contract is formed when we confirm your order by email.
4.3 If a product is out of stock after you have ordered, we will let you know and give you a full refund for that product, or offer an alternative if you would prefer.
4.4 If we make an obvious pricing or description error, we will contact you before dispatching. You can choose to go ahead at the correct price or cancel and receive a full refund.
4.5 We may limit quantities per customer for promotions or when stock is low. We may decline orders that appear to be placed for resale.
4.6 Payments are processed securely by Shopify and our payment providers. We do not store your full card details.
5. Food safety, ingredients and allergens
5.1 Allergens. Our blends contain milk, almond, macadamia and sesame. Always read the ingredients and allergen statement on the product page and the pack before eating our products. If you have a food allergy or intolerance, please check with your health practitioner before using them.
5.2 Fibre. Our blends are a good source of fibre. If you are not used to fibre-rich foods, start with half a sachet and drink plenty of water.
5.3 Health conditions. If you are pregnant or breastfeeding, have a medical condition, take medication, or are buying for a child, please check with your health practitioner before use.
5.4 Storage and best-before dates. Store sachets in a cool, dry place out of direct sunlight, and use them by the best-before date on the pack. Once opened, use the sachet straight away.
5.5 Tampering. Do not eat a product if the sachet or seal is damaged, open or appears tampered with. Contact us and we will replace it or refund you.
5.6 Recalls. If we ever need to recall a product, we will contact affected customers using the details from their order and publish the information on our website.
6. Promotions and discount codes
6.1 Promotions and discount codes are subject to the conditions shown with the offer, such as dates, eligible products and one code per order.
6.2 Discount codes have no cash value and cannot be applied to past orders.
6.3 Promotion conditions never limit your rights under the Australian Consumer Law.
7. Delivery
7.1 We deliver within Australia only. Delivery times on our website are estimates from Australia Post and our couriers, and may vary, especially in peak periods and regional areas.
7.2 Please make sure your delivery address is correct. If you choose "authority to leave", your parcel is delivered once it is left at your address.
7.3 Ownership and risk in the products pass to you on delivery.
7.4 If your parcel is lost or arrives damaged, contact us and we will work with the carrier to send a replacement or give you a refund.
8. Your rights under the Australian Consumer Law
8.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
8.2 For food, this means our products must be safe, of acceptable quality, match their description, and be fit for any purpose we tell you they are suitable for. For example, a product that arrives spoiled, contaminated, damaged, past its best-before date or with the wrong ingredients does not meet these guarantees.
8.3 If something is wrong with your order, please contact us as soon as you can with your order number, a description of the problem and, if possible, photos of the product and packaging. Telling us quickly helps us investigate, but it does not limit your rights.
8.4 Because food cannot be repaired, where a product fails a guarantee we will give you a replacement or a refund. For a major failure, you choose which.
8.5 For food safety reasons we will not usually ask you to return food products. If we do need a product back, we will tell you how and pay the reasonable cost of returning it.
8.6 We do not offer refunds if you simply change your mind. This does not affect your rights if a product is faulty.
8.7 For full details, see our Refund Policy.
9. Our liability
9.1 Our liability to you is limited only to the extent the law allows. Nothing in this section limits our obligations under the consumer guarantees.
9.2 We are not responsible for loss or harm that was not reasonably foreseeable, or that results from using our products other than as directed. This includes eating a product that contains an ingredient clearly disclosed on the label to which you are allergic, or ignoring the storage directions.
9.3 We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, carrier disruptions or supplier shortages. If this happens, we will tell you and give you the option of a full refund for anything not delivered.
10. Reviews and content you share
10.1 We welcome honest reviews. We publish genuine reviews from verified customers, both positive and negative, and do not edit them to change their meaning.
10.2 If you submit a review, photo, video or comment, you give us a non-exclusive, royalty-free licence to show it on our website, emails and social media, with your first name and last initial. You can ask us to remove it at any time.
10.3 Please don't post anything unlawful, offensive or misleading, or anything that includes someone else's personal information.
11. Intellectual property
11.1 Our brand, logo, recipes, photos, videos and website content belong to us or our licensors. You may share links to our website and view or print content for personal use, but you must not copy or use our content for commercial purposes without our written permission.
12. Privacy and marketing
12.1 We handle your personal information in line with the Privacy Act 1988 (Cth) and our Privacy Policy.
12.2 We only send marketing emails and SMS if you have agreed to receive them. Every message includes a simple way to unsubscribe.
13. Third-party services and links
13.1 Our website runs on Shopify and uses third-party services, such as payment providers, reviews and delivery tracking. Their own terms and privacy policies also apply when you use them.
13.2 Links to other websites are provided for convenience. We are not responsible for their content.
14. Changes to these terms
14.1 We may update these terms from time to time, for example to reflect changes in the law or our products. We will post the updated terms on this page with a new "last updated" date, and email subscribers about any significant change.
14.2 The terms in force when you place an order apply to that order. Changes do not apply to orders already placed.
15. Governing law
15.1 These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction. This does not affect any right you have to bring a claim in your own state or territory, or under the Australian Consumer Law.
16. Contact us and complaints
16.1 If you have a question or a complaint, please contact us first so we can help. Email us at hello@bettayou.com.au.
16.2 We aim to respond within 2 business days. If you're not happy with how we've handled your complaint, you can contact NSW Fair Trading or the consumer protection agency in your state or territory.
